利用規約

アプリ名: リバーシオン（Reversi-On）

この利用規約（以下「本規約」といいます）は、Hideki Games（以下「当方」といいます）が提供する iOS アプリケーション「リバーシオン」（以下「本アプリ」といいます）の利用条件を定めるものです。

第1条（適用）

  1. 本規約は、本アプリの利用に関する当方と利用者との間の一切の関係に適用されます。
  2. 利用者は、本アプリをダウンロードまたは利用した時点で、本規約に同意したものとみなされます。

第2条（定義）

本規約において、次の各号に掲げる用語の意義は、それぞれ当該各号に定めるところによります。

  1. 「利用者」とは、本アプリを利用するすべての方をいいます。
  2. 「対局」とは、本アプリ上で行われるリバーシの一局をいいます。
  3. 「オンライン対戦」とは、他の利用者と通信を介して行う対局をいいます。
  4. 「CPU対戦」とは、本アプリに実装されたコンピュータプログラムを相手として行う対局をいいます。
  5. 「レーティング」とは、オンライン対戦の結果に基づき当方が算出する数値をいいます。

第3条（利用料金）

本アプリは無料で提供されます。アプリ内課金および広告表示は行いません。ただし、本アプリの利用に必要な通信料金は利用者の負担となります。

第4条（アカウント）

  1. 本アプリは、初回起動時に利用者を識別するためのアカウントを自動的に作成します。アカウントの作成にあたり、氏名、メールアドレス等の入力は不要です。
  2. 利用者は、任意で Apple ID との連携を行うことができます。連携を行った場合、機種変更後もデータを引き継ぐことができます。
  3. Apple ID と連携していない状態で本アプリを削除した場合、アカウントおよびこれに紐づくデータを復元することはできません。 当方はこれについて責任を負いません。
  4. 利用者は、本アプリの「設定」画面からいつでもアカウントを削除することができます。削除されたデータを復元することはできません。

第5条（未成年者の利用）

利用者が未成年者である場合は、親権者その他の法定代理人の同意を得たうえで本アプリを利用するものとします。

第6条（表示名）

  1. 利用者は、本アプリ上で表示される名称（表示名）を設定することができます。表示名は他の利用者に公開されます。
  2. 利用者は、次のいずれかに該当する表示名を設定してはなりません。
  3. 他人の氏名、商標、その他の権利を侵害するもの
  4. 差別的、わいせつ、暴力的または公序良俗に反するもの
  5. 当方または第三者になりすますもの
  6. 広告、宣伝または勧誘を目的とするもの
  7. 当方は、前項に違反する表示名を、事前の通知なく変更または削除することができます。

第7条（禁止事項）

利用者は、本アプリの利用にあたり、次の各号に掲げる行為を行ってはなりません。

  1. 法令または公序良俗に違反する行為
  2. 改造したクライアント、自動操作プログラム（BOT）、その他の不正なツールを使用して対局を行う行為
  3. 複数のアカウントを使い分けて対局し、レーティングまたはランキングを操作する行為
  4. 他の利用者と通謀して意図的に勝敗を決める行為（いわゆる談合）
  5. 対局中に意図的に放置し、または通信を切断することにより、対戦相手の時間を浪費させる行為
  6. 定型メッセージを繰り返し送信するなど、他の利用者を困惑させる行為
  7. 本アプリまたはサーバーに対し、過度な負荷をかける行為
  8. 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブルその他の解析行為
  9. 本アプリの不具合を意図的に利用する行為、および発見した不具合を当方に通知することなく第三者に公開する行為
  10. 当方または第三者の知的財産権、名誉、その他の権利または利益を侵害する行為
  11. その他、当方が不適切と合理的に判断する行為

第8条（違反への対応）

  1. 当方は、利用者が前条に違反したと判断した場合、事前の通知なく、次の措置を講じることができます。
  2. 当該対局を無効とすること
  3. レーティングを調整または初期化すること
  4. ランキングへの掲載を取りやめること
  5. 本アプリの利用を一時的または恒久的に停止すること
  6. アカウントを削除すること
  7. 当方は、前項の措置により利用者に生じた損害について、責任を負いません。

第9条（対局および対局結果）

  1. 対局の進行、着手の有効性、勝敗および持ち時間の判定は、当方のサーバーにおける記録を正とします。利用者の端末に表示された内容が当方の記録と異なる場合、当方の記録が優先します。
  2. 通信の遅延または切断により対局が中断した場合の取扱いは、本アプリ内に表示される規則によるものとします。
  3. オンライン対戦において対戦相手が見つからない場合、本アプリは CPU 対戦へ移行します。この場合、その旨が画面に明示され、当該対局はレーティングに反映されません。
  4. レーティングおよびランキングは、当方が定める計算方法により算出されます。当方は、計算方法を変更することがあります。

第10条（サービスの変更・中断・終了）

  1. 当方は、利用者への事前の通知なく、本アプリの内容を変更し、または提供を中断することができます。
  2. 当方は、本アプリの提供を終了する場合、可能な限り事前に本アプリ内またはアプリの配信ページにて通知するよう努めます。
  3. 当方は、前二項により利用者に生じた損害について、当方の故意または重大な過失による場合を除き、責任を負いません。

第11条（保証の否認および免責）

  1. 本アプリは現状有姿で提供されます。当方は、本アプリに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、エラーやバグの不存在等を含みます）がないことを保証しません。
  2. 当方は、対局データ、棋譜、レーティングその他のデータについて、バックアップまたは復元の義務を負いません。
  3. 当方は、本アプリの利用により利用者に生じた損害について、当方の故意または重大な過失による場合を除き、責任を負いません。
  4. 前項にかかわらず、本規約が消費者契約法に定める消費者契約に該当する場合、当方の過失（重過失を除きます）による債務不履行または不法行為に基づく損害賠償責任は、利用者に現実に生じた通常の損害の範囲に限られるものとします。
  5. 当方は、利用者と他の利用者との間で生じた紛争について、一切関与せず、責任を負いません。
  6. 当方は、Google LLC その他の第三者が提供するサービスの障害または終了により本アプリが利用できなくなった場合について、当方の故意または重大な過失による場合を除き、責任を負いません。

第12条（知的財産権）

  1. 本アプリおよび本アプリに含まれるプログラム、画像、音声、その他一切のコンテンツに関する知的財産権は、当方または正当な権利者に帰属します。
  2. 「オセロ」は株式会社メガハウスの登録商標です。本アプリは同社とは関係がありません。本アプリで提供するゲームは「リバーシ」です。
  3. 対局の棋譜に関する権利の帰属については、当方はこれを主張しません。ただし、当方は本アプリの品質改善および統計処理のために棋譜を利用することができます。

第13条（個人情報の取扱い）

本アプリにおける利用者の情報の取扱いについては、別途定める「プライバシーポリシー」によるものとします。

第14条（本規約の変更）

  1. 当方は、必要と判断した場合、本規約を変更することができます。
  2. 本規約を変更する場合、当方は変更後の内容および効力発生時期を、本アプリ内またはアプリの配信ページにて事前に周知します。
  3. 変更後の本規約は、効力発生時期をもって適用されます。利用者が効力発生時期以降に本アプリを利用した場合、変更後の本規約に同意したものとみなされます。

第15条（分離可能性）

本規約のいずれかの条項またはその一部が無効または執行不能と判断された場合であっても、本規約の残りの部分は、継続して効力を有するものとします。

第16条（準拠法および管轄裁判所）

  1. 本規約の解釈および適用にあたっては、日本法を準拠法とします。
  2. 本アプリまたは本規約に関して当方と利用者との間で紛争が生じた場合、横浜地方裁判所横須賀支部を第一審の専属的合意管轄裁判所とします。

Terms of Service

These Terms of Service (the "Terms") govern your use of the iOS application "Reversi-On" (the "App") provided by Hideki Games ("we", "us").

This is a courtesy translation. The Japanese version is the authoritative text; in case of any discrepancy, the Japanese version prevails.

1. Application

These Terms apply to all relations between us and users concerning the App. By downloading or using the App, you agree to these Terms.

2. Fees

The App is free. There are no in-app purchases and no advertising. You are responsible for any data charges incurred.

3. Accounts

  1. An account is created automatically when you first launch the App. No name or email address is required.
  2. You may optionally link an Apple ID, which allows your data to be carried over to a new device.
  3. If you delete the App without having linked an Apple ID, your account and its data cannot be recovered. We accept no responsibility for this.
  4. You may delete your account at any time from the Settings screen. Deleted data cannot be restored.

4. Minors

If you are a minor, you may use the App only with the consent of a parent or legal guardian.

5. Display names

Your display name is visible to other users. You may not set a display name that infringes the rights of others, is discriminatory, obscene, violent or contrary to public order and morals, impersonates us or a third party, or serves advertising or solicitation purposes. We may change or remove such a name without prior notice.

6. Prohibited conduct

You may not:

  1. Violate any law or public order and morals
  2. Use a modified client, automation software (bots), or any other unauthorised tool to play games
  3. Use multiple accounts to manipulate ratings or leaderboards
  4. Collude with another user to predetermine the outcome of a game
  5. Deliberately go idle or disconnect during a game so as to waste your opponent's time
  6. Repeatedly send preset messages or otherwise harass other users
  7. Place excessive load on the App or its servers
  8. Reverse engineer, decompile or disassemble the App
  9. Deliberately exploit defects, or disclose discovered defects to third parties without first notifying us
  10. Infringe the intellectual property, reputation or other rights of us or any third party
  11. Engage in any other conduct that we reasonably deem inappropriate

7. Consequences of violation

Where we determine that you have breached Section 6, we may, without prior notice, void the game concerned, adjust or reset your rating, remove you from leaderboards, suspend your use of the App temporarily or permanently, or delete your account. We are not liable for any loss arising from such measures.

8. Games and results

  1. Our server records are authoritative as to the progress of a game, the validity of moves, the outcome, and time control. Where your device displays something different, our records prevail.
  2. Where no online opponent is found, the App switches to a CPU game. This is clearly indicated on screen, and such games do not affect your rating.
  3. Ratings and leaderboards are calculated by a method we determine, which we may change.

9. Changes, suspension and termination

We may change or suspend the App without prior notice. Where we discontinue the App, we will endeavour to give advance notice within the App or on its App Store page. We are not liable for loss arising from this except in cases of our intent or gross negligence.

10. Disclaimer and limitation of liability

  1. The App is provided "as is". We do not warrant that it is free from defects in fact or in law, including as to safety, reliability, accuracy, completeness, fitness for a particular purpose, or the absence of errors.
  2. We have no obligation to back up or restore game data, move records or ratings.
  3. We are not liable for loss arising from your use of the App except in cases of our intent or gross negligence.
  4. Notwithstanding the preceding paragraph, where these Terms constitute a consumer contract under Japan's Consumer Contract Act, our liability for damages arising from our negligence (excluding gross negligence) is limited to ordinary damages actually incurred.
  5. We are not involved in, and accept no responsibility for, disputes between users.
  6. We are not liable where the App becomes unavailable due to failure or discontinuation of services provided by Google LLC or other third parties, except in cases of our intent or gross negligence.

11. Intellectual property

  1. All intellectual property rights in the App and its contents belong to us or to the rightful owners.
  2. "Othello" is a registered trademark of MegaHouse Corporation in Japan. This App is not affiliated with that company. The game provided is Reversi.
  3. We assert no rights over the move records of your games, but may use them to improve quality and for statistical processing.

12. Privacy

Our handling of your information is governed by the separate Privacy Policy.

13. Changes to these Terms

We may amend these Terms. We will give advance notice of the amended content and its effective date within the App or on its App Store page. Continued use after the effective date constitutes acceptance.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.

15. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Yokohama District Court, Yokosuka Branch shall have exclusive jurisdiction of the first instance over any dispute arising in connection with the App or these Terms.
